On Tuesday, September 1, the Brazilian Data Protection Agency (ANPD) opened a call for contributions to develop its 2027-2028 Regulatory Agenda and its 2027-2030 Regulatory Outcomes Evaluation Agenda. The initiative seeks to gather input for defining the Agency’s regulatory priorities and the instruments to be assessed in the coming years.

The Regulatory Agenda serves as ANPD’s primary planning tool for regulatory activities, consolidating the topics that will be prioritized in the drafting of regulations and guidance documents. The agenda is organized around two thematic axes. The first focuses on promoting a safer digital environment, particularly for children, adolescents, and women. The second addresses privacy and personal data protection.

Initiatives under the first axis include measures related to: (i) parental supervision; (ii) the adoption of safe design standards by digital platforms; (iii) the use of generative AI by children and adolescents; (iv) platform transparency and accountability; (v) the availability of reporting channels and notification procedures for unlawful or criminal content; and (vi) combating the use of AI to generate and alter intimate content.

The second thematic axis, focused on privacy and personal data protection, addresses topics such as: (i) data subjects’ rights; (ii) biometric data and facial recognition; (iii) health data; (iv) generative AI and personal data protection; and (v) the review of automated decisions.

Regarding the 2027-2030 Regulatory Outcomes Evaluation Agenda, its purpose is to assess whether previously issued regulations have achieved their intended outcomes and to identify their impacts on individuals, organizations, and the market. The instruments scheduled for evaluation include the International Data Transfer Regulation and the Guidance on Age Assurance Mechanisms.

Contributions may be submitted via the Brasil Participativo platform until October 16.
